EPA has increased penalties for numerous violations of environmental laws and regulations. The Final Rule was published in the Federal Register on February 6, 2019 and applies to all violations that occurred or will occur after November 2, 2015 and for which penalties are assessed after February 6, 2019. 2018 NJ DEP Penalty Totals through 6/30/19
Baron has recently completed an analysis of NJ DEP’s penalty activities for inspections that occurred during the 2018 calendar year. A total 974 penalties were issued with a total cost to the regulated community of over $8.7 million dollars. As is typical, the Northern Region (consisting of the counties of Bergen, Essex, Hudson, Hunterdon, Morris, Passaic, Somerset, Sussex and Warren) issued the most penalties with 420 that totaled almost $4 million.
