Small Quantity Generator (SQG) Re-Notification Advisory Released

The NJDEP has issued a Compliance Advisory addressing the requirement for all Small Quantity Generators of Hazardous Waste to submit a re-notification by 9/01/21.


Facilities that are considered SQGs are facilities that generate more than 100 kgs but less than 1,000 kgs of RCRA non-acute hazardous waste in any single calendar month.


The United States Environmental Protection Agency (USEPA) Hazardous Waste Generator Improvements Rule became effective in New Jersey on 5/30/17. The rule requires SQG facilities to re-notify the USEPA, or their state environmental agency of their hazardous waste generator status every four years [40 CFR 262.18(d)(1)].


To re-notify, SQG facilities must electronically submit a Site Identification Form (Form 8700-12) using the RCRAInfo online system managed by USEPA. This online system can be found here. There is no fee to register for a RCRAInfo account or use the myRCRAid service.


Submittal of a complete Form 8700-12 anytime within the four years before the due date will meet the re-notification requirement. Therefore, if a SQG facility submitted an updated Form 8700-12 for a reason other than re-notification (for example, to update facility contact information) during the four years prior to the 9/1/21 due date, that facility is not required to make an additional notification until 9/1/2025.


Please note that the NJDEP no longer accepts hard copy of the Form 8700-12 document. All filings must be completed through the RCRAInfo portal.
